Research collaborations involving UiA should be based on written agreements.
The type of agreement to be drafted depends on various factors, including how the project is funded and organized.
Contact the legal expert in the Research and Innovation Department for assistance in drafting or quality assurance of agreements.
Research funded by the Research Council of Norway
UiA uses its own agreement templates based on the templates from the Research Council. These will be made available on this page in due course. In the meantime, contact the legal expert in the Research and Innovation Department for a copy of the agreement template.
Research funded by the EU
UiA uses the DESCA model for consortium agreements, which is the most widely used agreement template for EU-funded projects.
Contact the EU advisor and legal expert in the Research and Innovation Department for assistance with the establishment of EU projects.
Research funded by others
The research project is categorized as either a collaborative project or a commissioned project, depending on how it is funded and organized.
Collaborative project
A collaborative project is typically characterized by the following:
- UiA collaborates with one or more external partners, where the parties provide balanced contributions to the project and share both risks and results.
A legal expert in the Research and Innovation Department can assist with drafting agreements in collaborative projects.
Commissioned project
A commissioned project is typically characterized by the following:
- UiA performs tasks according to the instructions/order from an external party where there are clear requirements for UiA's deliverables.
- The external party has the right to make changes to the project, lodge complaints, and cancel the project.
Often, the external party will present a proposal for a project agreement. If not, UiA usually uses the project agreement template from the Norwegian Agency for Public and Financial Management (DFØ).
Non-disclosure agreements (NDA)
Confidentiality agreements are entered into when needed. Please contact a lawyer if you are unsure whether a confidentiality agreement should be entered into in your situation.
- Collaboration on joint project proposal
- Member of external assessment committee
- Other NDAs (contact a legal adviser)
Other contract types
- Memorandum of Understanding (MoU) (contact a legal adviser)
- Material Transfer Agreement (MTA) (contact a legal adviser)
Data protection
Agreements concerning data protection are managed by the Data Protection Advisor in the Research and Innovation Department. This includes, among others:
- Data Processing Agreement
- Joint Controllers Agreement
- Data Transfer Agreement
Who signs the agreement?
The practice at UiA is that agreements regarding research collaboration are usually signed by the faculty director.
The funding source may require agreements to be signed by others. EU projects typically require the signature of the university's legal signatory.
