Procedure for handling disruptive students

Adopted by the University Director on 29 August 2023.

Faculties/Departments/Teacher Education Unit

According to Section 12-5 of the Act relating to universities and university colleges:

(1) A student may be expelled with immediate effect if they disrupt teaching or the work of fellow students.

Regulations relating to study programmes and examinations at the University of Agder, Section 32:

(1) Statements regarding exclusion and decisions regarding annulment, expulsion, and exclusion in accordance with the Act relating to universities and university colleges, Sections 12-1 to 12-8, are made by the university’s Appeals Committee.

(2) The faculty board may expel a student with immediate effect if the student disturbs the teaching or the work of fellow students, see Act relating to universities and university colleges, Section 12-5).

The faculty board may delegate the power to expel students under Section 32(2) to the course coordinator (cf. letter from the Director of Academic Affairs to the faculties in August 2022).

If the course coordinator uses this option, they should then send a brief note to the legal adviser in the Division of Academic Affairs. The legal adviser informs the head of security if deemed necessary.

If a student exhibits disruptive behaviour, the employee in question should first contact their line manager to discuss the matter, as soon as challenges arise with a student, either in relation to the employee or other students. The line manager should log the conversation. Manager should assess whether the legal adviser in the Division of Academic Affairs should be contacted. The log should be stored in the archive system.

The legal adviser in the Division of Academic Affairs can provide guidance on the further process. The aim is for the individual employee to guide the student correctly (e.g. inform them of the possibility of applying for an individual exam instead of a group exam). The goal is to resolve the situation at the lowest possible level and prevent escalation.

The legal adviser in the Division of Academic Affairs assesses whether a case should be created in the archive system to gather relevant documentation and whether to issue a warning of expulsion if applicable. The legal adviser in the Division of Academic Affairs involves the head of security if deemed necessary.

The legal adviser in the Division of Academic Affairs and the employee assess what information can be shared with the faculty, department, and other students with regards to confidentiality.

The line manager has personnel responsibility for the employee and should assess whether to involve the Division of Human Resources/head of security in cases of direct harassment of named employees.
