Within a year: Dialogue meeting no.3

Both the employee, employer, doctor, and NAV can initiate an additional dialogue meeting, called dialogue meeting no.3. The meeting is not mandatory, but if any party requests it, NAV must invite and conduct the meeting.

The law does not provide specific details about when such a meeting should take place.

As an employee, you should attend this meeting with your employer, if medically advisable. The doctor who issued the medical certificate or other healthcare personnel will attend if NAV deems it appropriate.

The topics covered will include opportunities at the workplace, accommodations, and any limitations to enable your return to work.

The follow-up plan will be reviewed.

If necessary, rehabilitation or work-related measures provided by NAV may also be discussed.

If it is anticipated that the employee will be sick for more than 52 weeks, the immediate supervisor must at this point attempt to clarify the employee's future situation regarding:

  • various options for returning to work
  • duration of salary during illness
  • application for unpaid leave
  • different benefits from NAV or the State Pension Fund

Note: The right to sick pay from NAV ends once you have received sick pay for a total of 248 days within a 3-year period. Sick periods are counted as 100% absence, even if working partially. The last date for receiving sick pay is called the "maximum date." You must have worked full-time for 26 weeks to qualify for a new entitlement to sick pay.

Your duties as an employee:

Cooperate in finding solutions that allow you to return to work as quickly as possible.

Be willing to undertake other suitable or accommodated work if it can help you return to work more quickly.

Participate in the development and implementation of the follow-up plan.

Apply to NAV for potential AAP (Work Assessment Allowance) and SPK for disability pension under AAP if you cannot return to work after the maximum date. If you are over 67 years old, you will not be granted AAP from NAV, as you have a right to pension. You must apply for pension yourself. Remember that SPK has up to 3 months of processing time.
