Areas of responsibility

Kristian Mjåland is associate professor in sociology at the Department of sociology and social work. He earned his PhD in sociology from the Universtiy of Bergen in 2015. Mjåland has previously worked at Uni Research Rokkansenteret in Bergen and at the University of Cambridge. Mjåland’s research interests are mainly concerned with punishment, prisons, drugs, and coercive treatment. He is primarily a qualitative researcher, with considerable experience from ethnographic fieldwork and qualitative interviewing. Comparative penology has been his main research priorities the last few years. Theoretically, his research explores issues such as penal power, resistance, punishment, legitimacy and procedural justice. He is currently study program leader for the bachelor and master program in sociology. He teaches the bachelor course SV-218 (Deviance, crime and punishment) and the master course SV-436 (Crime control and punishment in the Nordic countries). Mjåland supervises bachelor-, master-, and PhD-students. Mjåland is a visiting scholar at the Institute of Criminology at the University of Cambridge.

Background For opioid use disorder (OUD), pharmacological therapy using methadone or buprenorphine, plus psychosocial support, is the most effective opioid agonist treatment (OAT). Long-acting injectable buprenorphine (LAIB) is the newest buprenorphine formulation. This study evaluated LAIB within a naturalistic clinical setting, compared with standard OAT (sublingual buprenorphine and methadone). Methods This observational study included patients from an OAT outpatient clinic in Agder County, Norway. Data were extracted from hospital medical records in May 2022. The cohort was followed up in February 2025. Medication-group transitions and outcomes were assessed by examining switching, discontinuation, mortality, and illicit substance use over three years. Results The study included 424 patients. The LAIB group was significantly younger than the standard OAT groups. During the study period, 13.2% of patients switched medications, increasing the LAIB group from 17% to 22%. Comparable proportions of patients experienced negative outcomes: 10% discontinued treatment, and 4% died. At follow‑up, illicit substance-use problems were less frequent in the sublingual buprenorphine group than the other groups, a finding that appears to have been influenced by differential attrition. Baseline substance use was the strongest predictor of illicit substance use at follow‑up. Conclusions The LAIB group slightly increased during the study period. Transitions between medication groups appeared to yield better substance-use outcomes at follow-up in the sublingual buprenorphine group, compared to in other groups. Baseline substance use was the strongest predictor of illicit use at follow‑up, suggesting that individual clinical characteristics may contribute more to outcomes than the specific medication pathway.

Much has been written about the Nordic model of punishment and how the penal systems of these countries are exceptional (as in exceptionally good and humane) from an international perspective. The concept of rehabilitation, and the more significant role it is supposed to play in Nordic prison systems, is often used to support claims about ‘Nordic exceptionalism’. However, the concept of rehabilitation, and what it means in practice, remains vague in much of this scholarship. Drawing on recent attempts to clarify the concept of rehabilitation, this chapter interrogates what rehabilitation looks like in Norway and what that might tell us about Nordic exceptionalism. We argue, drawing on the terminology offered by Raynor and Robinson (2009) and McNeill (2012), and in contrast to what is implied in some of the literature on Nordic penality, that the type of rehabilitation that characterises Norwegian penal practice is less correctional and psychological, and more concerned with social and legal dimensions: The rehabilitation approach in Norwegian prisons works more through principles than programmes. The chapter concludes that the most significant feature of the Norwegian approach to rehabilitation is that offenders are treated as citizens and retain their rights to welfare during and after their imprisonment.

A prison sentence is imbued with moral meaning about the offence which led to the punishment. However, based on interviews with prisoners serving typical sentences in England & Wales and Norway, we found that the offence was largely absent as a theme in staff-prisoner interactions during imprisonment. For some interviewees, the offence remained an absent-presence, which they tried to make sense of on their own, while others preferred to ‘get on with it’ and simply complete their sentence. We explore how the ‘absent-presence’ of the offence sometimes made punishment feel empty and meaningless, especially for prisoners who struggled to come to terms with their convictions. Drawing on the sociology of ‘nothing’ and the anthropology of ethics, we describe how the absent-presence of the offence can lead to confusion and misplaced shame, but at the same time foster positive relationships between the people who live and work in prisons.

There is a strong relationship between social class and crime. This relationship is particularly evident in Norwegian prisons, where there is an overrepresentation of persons from low socioeconomic backgrounds, many of whom are struggling with drug addiction. In this article we review research on drugs in prisons, and ask: What characterizes people’s drug use patterns before and during imprisonment? How common is it to begin using drugs in prison? What kind of drugs are used in Norwegian prisons, how do people gain access to them, and how does the presence of drugs affect social dynamics? The article tries to answer these questions by reviewing recent Norwegian and international research. In sum, the review suggests that: drug use is prevalent among approximately 30 per cent of inmates in Norwegian prisons; cannabis is the drug most frequently used; it is relatively common for people who use drugs prior to incarceration to stop using drugs while in prison, whereas onset in prison is very rare; those who report in-prison drug use also report frequent and relatively severe drug use (including polydrug use and the use of syringes) prior to their imprisonment; changing the type of drugs taken in prison is common; and drugs are not only sold but also shared in prison.

Bakgrunn: Legemiddelassistert rehabilitering (LAR) er forankret i spesialisthelsetjenesten og har siden oppstarten i 1998 hatt en kriminalitetsreduserende effekt. Det er likevel mange LAR-pasienter som jevnlig soner dommer i norske fengsler. For at denne pasientgruppen skal få en adekvat LAR-behandling i fengsel, forutsetter det et godt samarbeid mellom ansatte i LAR og fengselshelsetjenesten, hvor også pasienten bør ha en aktiv rolle i sin egen rehabilitering. Det finnes mye forskning på samhandling i helsetjenesten, men det mangler studier som undersøker samhandlingen mellom fengselshelsetjenesten og LAR. Hensikt: Utforske fengselssykepleieres opplevelse av samarbeid med ansatte i LAR-tjenesten. Metode: Undersøkelsen har et kvalitativt design med en induktiv tilnærming. Datasamlingen ble utført med semistrukturerte, individuelle intervjuer. Vi gjorde en tematisk analyse av datamaterialet basert på Johannessen, Rafoss og Rasmussens versjon etter Braun og Clarke. Resultat: Undersøkelsen viser at fengselssykepleierne opplever samhandlingen med LAR-tjenesten som utfordrende ut fra følgende hovedfunn: Det er lite kommunikasjon, informasjonsutveksling og gjensidig forståelse mellom fengselshelsetjenesten og ansatte i LAR. Knappe ressurser og fysisk avstand mellom LAR-foretakene og fengslene kan bidra til at pasienter ikke prioriteres av LAR-ansatte under soning. Fengselssykepleierne erfarer at det er store forskjeller mellom LAR-foretakene på hvordan samarbeidet fungerer, og det er komplisert å finne rett LAR-behandler. Det er særlig utfordrende når fastlegen har behandlingsansvaret. Konklusjon: Studien viser at fengselssykepleiere ved flere fengsler i Norge erfarer trepartssamarbeidet rundt LAR-innsatte som fraværende. LAR-retningslinjen oppfordrer til trepartssamarbeid, noe som ikke ser ut til å fungere i praksis. Konsekvensen kan være at pasienter som mottar LAR-behandling i fengsel, ikke får nødvendig oppfølging i tråd med LAR-retningslinjen.

Extreme forms of custody represent the boundary points of state power. The configuration of the most restrictive corners of prison systems, and what goes on within them, is highly instructive in exposing the objectives, limits, and implications of state coercion at its most severe. Based on data collected in England & Wales and Norway, this article has two main aims. The first is to explore the degree to which “deep-end” confinement differs between jurisdictions with different penal philosophies. The second is to understand how the most extreme form of confinement in each jurisdiction differs from the more typical carceral experiences within each system and its overall penal ethos. Empirically, then, the article seeks to shine light into the deepest dominions of both prison systems, illuminating the experiential texture of extreme forms of imprisonment. It concludes by asking what can be inferred about Nordic exceptionalism, and about deep-end confinement more generally, by analyzing these domains.

Based on a survey administered in 13 prisons in England & Wales and Norway, as part of a research programme with explicitly comparative aims, this article seeks to address both the relative and absolute dimensions of the Nordic penal exceptionalism thesis. It outlines the consistently more positive results in Norway compared to England & Wales, explaining them primarily with reference to the former’s much higher quality and use of open prisons. At the same time, it emphasizes that, even in an unusually humane prison system, prisoners report considerable pain and frustration. The article also makes the case that comparative analysis should strive to be systematic, but that such comparisons are always imperfect, making methodological transparency all the more essential.

The social world of prisons is typically described as hierarchical in the prison sociological literature where offence type, displays of (hegemonic) masculinity and involvement in the informal economy impact prisoners’ social standing. Based on fieldwork and interviews (N=181) with men and women in seven different Norwegian prisons, this article describes prisoner cultures where such hierarchies were either absent or of little significance. Rather than pointing out differences in status and standing, the prisoners interviewed tended to insist that they were equal and the same. In order to make sense of this finding, which contrasts dominant accounts in the prison sociological literature, the article engages with scholarship on the role and roots of egalitarianism in Norwegian society. Organizing the discussion around the concepts of ‘egalitarian permeability’, ‘pragmatic egalitarianism’ and ‘social labour’, the article argues that the egalitarian culture of Norwegian (open) prisons is shaped by norms in the wider Norwegian society and the pragmatic choices prisoners make to cope socially in prison everyday life.

Comparative penologists have described neoliberal and social democratic jurisdictions as though they exist at opposite ends of a continuum of inclusion and exclusion, and as though neoliberal states are inactive and social democratic states are invasive. This article, which is based on more than 129 interviews with men convicted of sex offenses in England & Wales and Norway, uses Cohen's work on inclusion and McNeill's typology of rehabilitative forms to complicate this simplistic binary. It argues that the punishment of men convicted of sex offenses in England & Wales was demanding but exclusionary; it imposed strict legal restrictions on these men during and after their imprisonment, blocking them from engaging in social and moral rehabilitation and providing a limited and treacherous route to change. In Norway, punishment operated in a way that was formally inclusionary but surprisingly laissez-faire: Prisoners retained their legal rights during and after their incarceration, but the lack of opportunities to discuss their offending meant that their sentences were rarely experienced as meaningful, and their formal inclusion was not enough for them to feel substantially included after release.

Open prisons are portrayed as less harmful custodial institutions than closed prisons, and prison systems that rely more heavily on low security imprisonment are typically considered to have a more humane and less punitive approach to punishment. However, few studies have systematically compared the subjective experiences of prisoners held in open and closed prisons, and no study has yet compared the role and function of open prisons across jurisdictions. Drawing on a survey conducted with prisoners (N = 1082) in 13 prisons in England and Wales and Norway, we provide the first comparative analysis of experiences of imprisonment in closed and open prisons, conducted in countries with diverging penal philosophies (‘neoliberal’ vs. ‘social democratic’). The article documents that open prisons play a much more significant role in Norway than in England and Wales; that prisoners in both countries rate their experience significantly more positively in open compared to closed prisons; and that while imprisonment seems to produce similar kinds of pains in both types of prisons, they are perceived as less severe and more manageable in open prisons. These findings suggest important implications for comparative penology, penal policy, and prison reform.

Kriminalomsorgen har ansvar for å gjennomføre straffene som domstolene foreskriver, med unntak av de rene pengestraffene. I denne artikkelen utsetter vi kriminalomsorgens ferske virksomhetsstrategi for kritisk nærlesning. Utgangspunktet vårt er spenningen som oppstår når en offentlig etat som er relativt usynlig, går aktivt ut og forsøker å formidle sine målsetninger og selvforståelse. Vi sammenlikner strategiteksten med to slike tekster kriminalomsorgen har publisert tidligere, i henholdsvis 2004 og 2014, og analyserer alle tre i lys av de siste to tiårs straffepolitiske hovedlinjer og fokusskifter.

This article explores the implications of the ‘imprisonment queue’ in Norway. Based on interview data (N = 200), we show that while interviewees waiting to serve their sentences enjoy certain benefits such as being able to prepare for or negotiate the terms of their imprisonment, they also suffer from uncertainty and powerlessness. The suspension of their lives while they wait hinders them in pursuing their ground projects, things that really matter to them. This peculiar phenomenon has not received attention from prison scholars generally, as well as scholars writing on Nordic Exceptionalism specifically. This article addresses that gap and poses questions about the relative mildness of the short Norwegian sentences, and more broadly, about what constitutes punishment.

Background: Despite the fact that drug-assisted rehabilitation (LAR) has a crime-reducing effect, LAR patients are well represented in Norwegian prisons. There is little knowledge about cooperation between LAR and the prison health service around patients during incarceration, and for this reason prison nurses' experience with LAR treatment in prison will be explored. Objective: The purpose of the study is to highlight the prison nurse's experiences with LAR treatment and collaboration with the LAR offices. The study will be able to give LAR and the prison health service increased insight and understanding of each other's context, where the goal is a better collaboration. New knowledge will be used in the treatment of LAR patients, in the prison health service and in other interested parties affiliated with LAR. Furthermore, the study may add new knowledge to the research field. There are limited studies on LAR treatment from the perspective of prison nurses. The study's research question is: How do prison nurses describe their experiences with LAR treatment in prison? Method: The master's thesis is a qualitative study where semi-structured individual interviews are used in data collection. The study has a phenomenological approach, where the interviews seek descriptions of the interviewee's world of life. Analysis of data is inspired by thematic analysis of Braun & Clarke's model. Results: The informants describe different models for medical delivery and focuses on inmates’ mental health in the care of LAR treatment. The diversion makes the responsibility for LAR in prison challenging. The informants describe a lack of cooperation with LAR. Conclusion: The study provides knowledge about how medication delivery is carried out and that diversion of medications is a major problem. The prison nurses take care of the prisoners’ mental health with support calls and daily contact. The prison nurses want more cooperation and interaction with LAR.
